Can I Get A FFL With My Florida Gun Trust ?
In short the answer is a resounding NO. A Florida gun trust is neither a person or a corporation and therefore will not be issued a Federal Firearms License. Once you have decided to make an application for a Federal Firearms License (commonly referred to as an “FFL”), send the completed application to the ATF post office box listed on the application form, Application for License (FFL) – ATF Form 7/7CR. The application must be accompanied by the proper application fee, which you can pay by check, credit card or money order (we do not accept cash).
First review and background check
Once the application fee is processed, the Federal Firearms Licensing Center (FFLC) will enter your application information into its database and commence a full review of your application. For all license types, except type 03, required supporting materials, including fingerprint card(s) and photograph(s) will also be reviewed.
As required by law, the FFLC will then conduct an electronic background check on all the Responsible Persons you have identified on your application. ATF defines a Responsible Person (RP) as a sole proprietor, partner, or anyone having the power to direct the management, policies, and practices of the business or activity as it pertains to firearms. In a corporation this includes corporate officers, shareholders, board members, or any other employee with the legal authority described above. All responsible persons must complete their own Part B – Responsible Person Questionnaire of the ATF Form 7/7CR.
For all license types, except type 03 (onsite inspections are not required for Collector of Curio and Relics FFLs), the FFLC will then send the applications to the nearest ATF field office having responsibility for the area in which the business is located.
Interview and final review
The field office supervisor will issue an assignment to an Industry Operations Investigator (IOI) who will conduct an in-person interview with you. The IOI will discuss federal, state and local requirements with you, and go over your application with you to ensure the information is correct and current.
The IOI will then prepare a report of his/her interview, the inspection and make a recommendation to either issue you the license or deny the application. Some reasons for denial may include failure to comply with State or local law (such as zoning ordinances), evidence of previous willful violations of the Gun Control Act, or falsification of the application.
The field office supervisor will also review the report and then submit his/her recommendation to the FFLC.
Assuming that all background checks have been completed and your business address and proposed business operations are in compliance with state and local law, the FFLC will complete the application processing and issue you the license. This process will take approximately 60 days from the receipt of a properly completed application.
1. Decide to become a Federal Firearms Licensee (FFL).
2. Go to www.ATF.gov and locate the required form (ATF Form 7).
3. Complete and mail in an accurate application (ATF Form 7) with the proper licensing fee to the address listed on the form.
4. The Federal Firearms Licensing Center (FFLC) records the application information and reviews the the form for correctness.
5. The FFLC conducts a background check on the “responsible persons”.
6. The new license application is sent to your local ATF field office.
7. At your local ATF field office, an Industry Operations Investigator (IOI) will conduct an in-person interview with you.
8. The IOI prepares a report and makes a recommendation on whether or not ATF should issue or deny the license to their area supervisor.
9. The area supervisor reviews the report and submits his/her recommendation to the FFLC.
10. Assuming all background check have been completed and your business is in compliance with state and local law, the FFLC will issue the license.
The entire process takes about 60 days from the time your correct application was first received at the FFLC.
A Class 3 Federal Firearms License is a federal license issued through the Bureau of Alcohol, Tobacco, Firearms and Explosives. Under the National Firearms Act, it is legal under federal law to own a class 3 firearm; however, state and local laws may limit or prohibit owning it. The state of Florida does allow individuals to own class 3 firearms, provided that the individual complies with the federal licensing requirements under the NFA.
Contact the local chief law enforcement officer of the area in which the applicant resides and request information on local laws and requirements for class 3 firearms and class 3 firearms licenses. This can be either the city chief of police, the county sheriff or the state chief of police.
Contact the local branch office of the ATF and request information on applying for a class 3 firearms license. Listings for field offices can be found online.
Download and print a copy of the Application for Tax Paid Transfer and Registration of Firearm. This application is available online at the ATF website. Applicants should note that applications must be filed in duplicate, so two applications must be printed and completed.
Take a photo that is approximately 2 inches by 2 inches, or the size of a passport photo. One photo will need to be attached to each copy of the application.
Complete the applicant/transferee’s information portions of the applications and attach the photos to the applications.
Request the dealer/transferor complete the required section of the applications requiring the transferor’s federal firearms license number, information and signature.The transferor must be licensed in the state of Florida to sell class 3 firearms to a Florida resident. Also complete the section requiring the firearm’s description and serial number, ensuring that all information is correct and accurate.
Visit the chief law enforcement officer of the area in which the applicant resides to have him complete and sign both copies of the section for the CLEO.
Take two sets of fingerprints on FBI Forms FD-258. These can be done by any law enforcement agency and must be attached to the applications.
A “Class III” weapons permit, also referred to as a National Firearms Act (NFA) license, gives you the ability to buy and sell weapons that are illegal for most Americans to own without a special permit. Class III weapons include machine guns, suppressors (silencers,) short-barreled rifles and shotguns, and a broad category of weapons the Bureau of Alcohol, Tobacco, and Firearms (BATF) refers to as “any other weapon,” or AOW.

Order a Form 5310.12(Form 7) from the BATF by calling 707-455-7801 or going to http://www.atf.gov/forms/dcof/ to order one online. You will receive the application you need for your license. There is no additional paperwork for the State of Texas.

Ask the police chief to sign the document from the BATF that states he approves of you having an NFA license. Get a copy of your criminal background check, which the local police department can provide.
Send in the appropriate amount of money with your application by certified check. There are varying amounts of money needed, which will be listed in the application, depending on exactly what you need your license to cover. The “any other weapons” clause is broad and the amount of money to send would be different if you wanted to sell grenades versus some type of specialty ammunition.

Notify the head of the local law enforcement agency of your business location. When your application is approved, you have a Class III firearm license in Texas. The license is valid for three years.
